Stephen T. Trigg

Stephen has extensive experience representing clients over twelve years in a wide variety of civil litigation matters in both state and federal courts. Stephen’s practice includes cases involving complex commercial disputes, catastrophic personal injuries, and disputes between shareholders and members of closely-held businesses. Stephen regularly represents defendants in professional malpractice actions against doctors, chiropractors, dentists, podiatrists, nursing homes, and other healthcare providers.

Prior to joining Gass Turek, Stephen practiced with Paul Hastings in New York City for five years. At that firm, he represented multiple companies and their boards of directors in shareholder disputes alleging breaches of fiduciary duties and securities law violations. He also represented some of the world’s largest financial institutions in litigation resulting from the credit crisis.

Professional Malpractice Defense

  • Secured a unanimous jury verdict in favor of a chiropractor client following a seven-day jury trial in Waukesha County.
  • Obtained summary judgment in the Eastern District of Wisconsin on behalf of a psychiatrist who formerly provided services at the Milwaukee County Criminal Justice Facility, in defense of claims for alleged constitutional violations related to mental health care that was provided to the plaintiffs.
  • Secured multiple summary judgment victories on behalf of independent contractor physicians practicing in the Wisconsin Department of Corrections system and at county jails.

Dispositive Motions

  • Obtained a $2.4 million summary judgment award against a nursing home for breach of contract and personal tort liability against the individual managing member of the entity that operated the nursing home for conversion and civil theft. Milwaukee Center for Independence, Inc. v. Milwaukee Health Care, LLC, 929 F.3d 489 (7th Cir. 2019).
  • Obtained dismissal of a personal injury action in New Jersey for lack of personal jurisdiction involving a New Jersey resident who suffered severe, permanent injuries when he dove into a pool in the middle of the night at a resort in Destin, Florida. Obtained dismissal of a subsequent Florida suit for the same injuries based on the running of the statute of limitations in Florida while the case was pending in New Jersey.
  • Secured the prompt dismissal of a trust’s claims against a large, national life insurance company for making distributions to an allegedly unscrupulous trustee. The trust did not appeal the federal judge’s decision granting the life insurer’s motion to dismiss. Kriete Family Insurance Trust v. Pacific Life Insurance Company, 2017 WL 3273580 (E.D. Wis. 2017).
